Terms of Service

These Terms of Service govern your access to and use of the 2safiri platform. By creating an account, signing in, or otherwise using the service, you agree to be bound by these terms.

1. Who we are

2safiri provides a software platform for transport, fleet and parcel logistics operators. References to “we”, “us” and “our” mean 2safiri acting in its capacity as operator of the platform.

References to “you”, “your” and “the operator” mean the organisation or individual that holds an account with us, and any person you authorise to use the account on your behalf.

2. Eligibility

You may only create an account if you are at least 18 years old and legally able to enter into a binding contract. If you sign up on behalf of a SACCO, company or other organisation, you confirm that you are authorised to bind that organisation to these terms.

You must hold all licences, permits and registrations required by Kenyan law to operate vehicles, employ drivers, carry passengers or move parcels. The platform does not replace any regulatory authorisation.

3. Your account

You are responsible for the accuracy of the information you provide at sign-up and for keeping your account credentials confidential. You must notify us promptly if you suspect unauthorised access to your account.

Everything done through your account is treated as done by you, including actions taken by personnel you add through the personnel and roles sections of the platform.

4. How you may use the platform

We grant you a non-exclusive, non-transferable, revocable right to use the platform during your subscription, solely for your own business operations.

You must not copy, reverse engineer, resell or sublicense the platform, attempt to gain unauthorised access to other accounts, or use the service in any way that breaches our Acceptable Use Policy.

5. Vehicles, drivers and end-users

You are solely responsible for the conduct of your drivers, conductors and any personnel you grant access to. This includes ensuring drivers are licensed, vehicles are roadworthy and properly insured, and parcels are handled in accordance with applicable law.

You are responsible for the relationship with your passengers, parcel senders and recipients. The platform records bookings and shipments but does not itself transport people or goods.

6. Fees and billing

Use of the platform is subject to subscription fees, as published in your account dashboard or otherwise communicated to you in writing. Fees may be charged per vehicle, per active user or on another basis we notify in advance.

Fees are payable in advance unless otherwise agreed. Failure to pay may result in suspension or termination of your account.

7. Third-party services

The platform integrates with third-party services including Google Maps for routing and geolocation, Safaricom M-Pesa for collections, Keycloak for identity and authentication, and email delivery providers.

Your use of these services is subject to the providers’ own terms. We are not responsible for outages, changes or failures in third-party services. M-Pesa till and shortcode information that you configure is your responsibility to keep accurate and authorised.

8. Suspension and termination

We may suspend or terminate your access if you breach these terms or the Acceptable Use Policy, if we are required to do so by law, or if your continued use poses a material risk to other users or to the platform.

You may close your account at any time as described in our Account Deletion policy. Subscription fees already paid are not refundable except where required by law.

9. Intellectual property

All software, branding, designs and content that make up the platform are owned by 2safiri or its licensors. Nothing in these terms transfers ownership of that intellectual property to you.

You retain ownership of the data you upload. By using the platform, you grant us the limited rights needed to host, process and display that data for the purpose of providing the service.

10. Disclaimers and limitation of liability

The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the platform is limited to the fees you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for loss of profits, loss of business, loss of goodwill, or any indirect or consequential loss.

11. Indemnity

You agree to indemnify and hold harmless 2safiri, its officers, employees and contractors from any claim, loss or expense arising out of your use of the platform, your breach of these terms, or your handling of passengers, parcels or personnel.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Kenya. The courts of Kenya have exclusive jurisdiction over any dispute arising out of or relating to these terms, except that we may seek injunctive relief in any competent court.

13. Changes to these terms

We may update these terms from time to time. If a change is material, we will notify you through the platform or by email at least fourteen (14) days before it takes effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
